The mediation process can safely be started prior to each party paying hundreds or thousands of dollars to retain an attorney. Attorneys who are supportive of the mediation process can then be retained to provide an independent legal judgment and process the appropriate documents through the Court for an uncontested divorce.
If a divorce has already been filed, mediation can successfully be used at anytime if both parties are willing to meet in an effort to reach agreement on unresolved issues. Mediation sessions can be held with or without attorneys present. If attorneys are not present, the parties will have an opportunity to consult with attorneys to review the agreements reached in mediation. The sooner the parties reach anacceptable agreement, the less the financial and emotional cost to the family.
